Although collaborative divorce may be a process that is new to many people, it has many upsides for divorcing couples to consider. Compared with traditional divorce litigation, which can also help guide divorcing couples through the divorce process, collaborative divorce offers several benefits divorcing couples should be aware of.

There have been many changes to divorce laws of late, including that divorce laws are no longer fault-based; child custody now focuses on parenting rights and responsibilities; and alimony, or spousal support, has also undergone some changes as well, related to the amount and duration or spousal support. Collaborative divorce is a process that allows divorcing couples to have more control over their divorce process, rather than having the family law court decide for the couple.

Collaborative divorce is a process that is informative for the divorcing couple and also carries with it less cost and stress to minimize the potentially negative impacts of divorce on the couple and family. Collaborative divorce negotiations take place in a setting that is structured and intended to be less adversarial. If the couple decides to abandon the collaborative divorce process in favor of a litigated divorce, their representatives will be required to withdraw, which creates another incentive for the parties to negotiate their divorce settlement.

The advantages of collaborative divorce include: a cooperative environment; an open and honest exchange; preservation of the integrity of family relationships; a team approach that actively involves the family in the process; and reduced time and cost. Collaborative divorce can lead to an amicable settlement that is best all around for the couple, family and any children who may be involved, which is why it is worth considering.
